Avelis is an AI-powered platform designed to assist insurance professionals in streamlining claims management and enhancing operational efficiency. Our Services include advanced analytics, automated reporting, secure messaging, and various other functionalities to support your business processes.

2. Privacy and Data Usage

We are committed to protecting your personal and professional information in accordance with applicable laws and regulations. Please refer to our Privacy Policy for details on how we collect, use, and safeguard your data.

Data Ownership
You retain full ownership of all data you upload to our platform. By using the Services, you grant us a non-exclusive, royalty-free, worldwide license to process, analyze, and store your data solely for the purpose of delivering our Services.

Compliance
It is your responsibility to ensure that any data you share with Avelis complies with all applicable laws, including, but not limited to, data protection and privacy regulations.

3. Registration and Account Security

To access our Services, you must create an account by providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Please notify us immediately if you suspect any unauthorized use of your account.

4. Service Availability and Changes

While we strive to provide continuous access to our Services, we cannot guarantee uninterrupted or error-free operation. Scheduled maintenance, updates, or unforeseen circumstances may temporarily affect availability.

Avelis reserves the right to modify, update, or discontinue the Services, in whole or in part, at any time without prior notice. We may also restrict access to certain features or the entire Service in specific regions or jurisdictions.

5. Age and Eligibility

The Services are intended for professional use by individuals who are at least 18 years old and have the legal authority to enter into binding agreements. By using our Services, you confirm that you meet these eligibility requirements.

6. Prohibited Activities

You agree not to engage in any activities that could compromise the functionality, security, or integrity of the Services. This includes, but is not limited to:

  • Submitting false, inaccurate, or fraudulent claims data.

  • Attempting to reverse-engineer, duplicate, or tamper with our AI models.

  • Using the Services for any unlawful, fraudulent, or malicious purposes.

  • Interfering with or disrupting the operation of the platform.

  • Accessing the Services through unauthorized means.

7. Intellectual Property

Our Content
All intellectual property rights in the Services, including software, algorithms, user interfaces, and trademarks, are owned by Avelis Technologies Limited.

User Content
You retain ownership of any data or content you provide. However, you grant Avelis a license to use, modify, and display your content as necessary to operate and improve our Services.

8. Payment Terms

Access to certain features of the Services may be subject to fees. By subscribing to or using such features, you agree to pay all applicable charges as outlined during the registration or subscription process.

Refunds
Unless expressly stated otherwise in a separate agreement or as required by law, all fees are non-refundable.

9. Disclaimers

The Services are provided "as is" without any warranties, express or implied. Avelis does not warrant that the Services will meet your specific requirements or be free from errors, interruptions, or security breaches.

10. Maintenance and Destruction of Confidential Data

10.1 Scope of Confidential Data
Any information uploaded to or generated within the Avelis platform that is identified as confidential or that a reasonable person would consider confidential under the circumstances (collectively, "Confidential Data") falls within the scope of this section. This includes, but is not limited to, personally identifiable information (PII), proprietary business data, and any other sensitive information used for claims management.

10.2 Maintenance and Storage

  1. Security Controls

    • Avelis implements technical, administrative, and physical safeguards designed to protect Confidential Data against unauthorized access, disclosure, alteration, and misuse.

    • These safeguards may include, but are not limited to, encryption in transit and at rest, secure data centers, role-based access controls, and regular security assessments.

  2. Retention Period

    • Unless otherwise instructed by you in writing or required by applicable law, Avelis retains Confidential Data only for as long as reasonably necessary to fulfill the purposes for which it was collected, or as required by our legitimate business needs (e.g., to provide the Services) or legal obligations.

  3. Backup and Redundancy

    • Avelis may maintain backup copies of Confidential Data in geographically dispersed locations to ensure resilience and business continuity.

    • These backups are governed by the same security measures outlined in these Terms.

10.3 Destruction and Disposal

  1. Requesting Data Deletion

    • You may request deletion of your Confidential Data at any time by contacting us at support@avelis.com. Upon receiving such a request, we will make commercially reasonable efforts to securely erase or anonymize your Confidential Data from our active systems within a reasonable timeframe, unless legal obligations require otherwise.

  2. Automated Data Destruction

    • Where feasible and lawful, Avelis will periodically perform automated cleanup of older or unnecessary Confidential Data.

    • Data destruction is conducted in a manner designed to ensure that the data cannot be reconstructed or recovered.

  3. Termination of Services

    • Upon termination or expiration of your account, Avelis will, within a reasonable timeframe, securely destroy or anonymize your Confidential Data in our active systems, unless otherwise required by law or unless you request immediate data return or deletion.

10.4 Compliance with Applicable Laws
Avelis will abide by all applicable data protection and privacy regulations relating to the maintenance, retention, and destruction of Confidential Data. You are responsible for ensuring that your use of the Services, including your instructions regarding data deletion, complies with any obligations you may have under relevant laws.

10.5 Limitation
Avelis is not responsible for the protection, retention, or deletion of Confidential Data once it has been exported, downloaded, or otherwise shared outside of the Avelis platform by you or at your direction.
